General Sales Conditions

The products purchased on VITALEBOUTIQUE.IT are sold directly by Vitale Srl, a company incorporated under Italian law, with registered office in Via Firenze,68 registered at the CCIAA of Crotone KR under n. 160361, C.F./P.IVA 02474540792.

The offer and sale of products on the site VITALEBOUTIQUE.IT are governed by these General Conditions of Sale.

The General Terms and Conditions of Sale may be periodically updated; the ones published on VITALEBOUTIQUE.IT accepted at the moment of check out are considered effective and binding. 

Please read carefully the terms and conditions of sale before purchasing.

 

Purchase methods

For each product chosen, a descriptive card is displayed, with the image and essential characteristics, for example: the technical types of the product, the colour, the size, the unit price. 

The images and colours of the products offered for sale on VITALEBOUTIQUE.IT may not correspond to the actual ones due to the Internet browser and/or monitor used: Vitale Srl is not responsible for any inaccuracies due to a particular configuration of the computer or its malfunction.

Product availability

The products offered for sale and their prices are those indicated on VITALEBOUTIQUE.IT

If, at the time of the order, the products are not available, the product in the corresponding size is not displayed.

If, due to simultaneous purchase by several customers, the product ordered is no longer available, an order cancellation e-mail is sent.

Vitale Srl may change at any time and without notice the products offered for sale on VITALEBOUTIQUE.IT and their price.

 

Price of product

The price of each item is indicated in Euro: including taxes (VAT), excluding shipping costs for the countries of the European Union.

European Union countries. Taxes excluded (VAT), shipping costs excluded for countries outside the European Union.

The cost of shipping and any customs charges is indicated before payment and calculated according to the destination of the goods. (Shipping methods)

 

ORDER

Order

Placing an order implies knowledge of these general terms and conditions of sale and their unconditional acceptance.

Orders may be placed after registration and/or creation of a personal account ("free registration") by the Customer. Please remember to read the Privacy Policy and the Terms and Conditions of Sale carefully.

Orders are placed by following the steps and instructions specified on the site. 

The purchase of products offered for sale on VITALEBOUTIQUE.IT can be made by consumers/clients who have reached the age of majority and acting exclusively on their behalf.

The sale and / or distribution of products purchased on VITALEBOUTIQUE.IT is prohibited

Vitale srl reserves the right to evaluate the acceptance of orders received.

Vitale srl will notify the customer via e-mail if it is impossible to accept the orders received.

 

Order confirmation

At the time the purchase is concluded, the customer receives written confirmation of the product ordered, indicating the "order confirmation code", the amount to be paid, with details of the product price and shipping costs and any customs charges for non-EU countries.

Vitale srl will send a subsequent confirmation of the order by e-mail with the relevant delivery times for the product.

 

Payment methods

Vitale srl accepts payments made with the following credit and debit cards: PAYPAL, VISA, MASTERCARD, AMERICAN EXPRESS and bank transfer for domestic sales only. Payments by cheque are not accepted and the courier cannot give any change. To request a refund if cash on delivery is the method of choice, you must have a bank account: with this payment method refunds can only be issued by bank transfer to your account.

If you buy with Scalapay you receive your order immediately and pay in 3 instalments. You acknowledge that the instalments will be assigned to Incremento SPV S.r.l., related parties and their assignees, and that you authorise such assignment.

Important information: following the new laws that have come into force in Italy and France, the maximum threshold for the cash on delivery payment method has been limited for shipments to these two countries.

Italy: the total order is limited to €1,999.99.

France: total order is limited to €750.00

The products ordered remain the property of Vitale srl until the relative price is collected in full.

 

Access and transaction security

Appropriate security measures are implemented, in accordance with the "Final Guidelines on Internet Payment Security" - The Service is activated including the 3D Secure protocols.19 December 2014 issued by the European Banking Authority, to protect sensitive data.

In case of payment by credit card, the financial information (for example, the credit/debit card number or the date of its expiration), will never be used by the Seller except to complete the procedures relating to your purchase and to issue refunds in case of any returns of products, or if it is necessary to prevent or report to the police the commission of fraud on VITALEBOUTIQUE.IT.

 

SHIPPING METHODS

Shipping Methods

Information on shipping methods, costs and possible customs charges are indicated at the time of purchase. Shipping costs and customs charges are the responsibility of the customer and are charged to your credit or debit card at the time of purchase.

 

Shipping costs

All purchases with addresses in Italy and the islands (Italy) are delivered by GLS courier.

For all other destinations, DHL and GLS couriers are used. We do not ship to PO boxes.

 

The following table shows the shipping costs for different amounts :

ITALY € 7;

ISLANDS € 10;

INTERNATIONAL FROM 25 EUROS TO 500 EUROS.

For purchases over 400 Euro shipping is free of charge.

N.B. For shipments that are subject to customs duties, a fee or tax must be paid for transporting the goods across international borders (to be paid by the recipient customer). 

All orders are delivered by GLS courier and DHL courier from 9am to 5pm, Monday to Friday. The forwarding agent requires the recipient's signature 'for receipt' upon delivery.

Once the items have been shipped, it is no longer possible to change the destination address.

From receipt of order the delivery time of the products is as follows:

ITALY: 2 - 3 working days

ISLANDS: 3 - 4 working days

USA - CANADA : 1-3 working days depending on destination

EUROPE - EU STANDARD SHIPPING : 2-6 working days depending on the destination

EUROPE - EU UNION EXPRESS SHIPPING : 1-2 working days for main destinations, 2-3 working days for remote destinations

EUROPE EXTRA EU EXPRESS SHIPPING : 1-2 working days for main destinations, 2-3 days for remote destinations

LATIN AMERICA : 3-4 working days

ASIA AND MIDDLE EAST : 4 working days

AUSTRALIA AND OCEANIA : 4 working days for main destinations, 4-5 days for remote destinations

AFRICA : 2-4 working days

RUSSIAN FEDERATION : 3-4 working days - approximately 15 working days EMS Russian Post

Deliveries are made and guaranteed by GLS and DHL.

All orders are delivered by GLS and DHL courier between 9 a.m. and 5 p.m., Monday to Friday . The forwarding agent requires the recipient's signature 'for receipt' upon delivery.

Please provide a valid address to which the goods should be delivered during the delivery times. Please indicate any change of address in good time.

It is not possible to change the destination address after dispatch.

At the time of shipment, Vitale srl shall inform the Customer by e-mail of the courier's delivery number. 

Products may also be delivered by partial shipment: in this case only the price of the products shipped and the cost of the individual shipment will be charged. In the event of partial shipment, information is given by email.

Any delivery delays of more than 10 (ten) working days must be promptly reported to our Customer Service "[email protected]" and in any case within 30 (thirty) calendar days from order confirmation.

 

Receiving merchandise

In order to guarantee the security of the shipment, the forwarding agent asks for the "receipt" signature of the recipient at the time of delivery; if this is not possible, the goods are not delivered.

If, upon delivery, the external appearance of the parcel shows imperfections, the customer must proceed to open the parcel in the presence of the carrier

We recommend checking the goods upon delivery and verifying that the quantity of products delivered corresponds to what was ordered, and that the packaging is intact, undamaged, or otherwise altered. Any anomalies must be noted in writing on the courier's delivery note.

Any problems with the delivery must be promptly reported to our Customer Service [email protected] and in any case within 30 (thirty) calendar days from confirmation of the order.

 

Insurance

All packages shipped are insured against theft/loss and damage from the moment they are handed over to the courier for shipment until delivery to the recipient. 

If the package is damaged upon delivery, we recommend that you either refuse the goods or indicate on the delivery note that you are accepting a damaged package.

Once delivered to the specified address and collected, the goods are no longer insured. 

 

RETURNS AND EXCHANGES

Returns and Exchanges

If the products are not satisfactory, you may request a refund or exchange.

The conditions for exchanges and returns are as follows:

 

Returns Procedure

Purchased goods may be returned within 14 days from the date of delivery.

Shipping costs are borne by Vitale Srl for domestic shipments.

Returns made after the deadline can only be accepted at the discretion of Vitale srl.

Vitale srl shall reimburse the full cost of products returned by the Customer provided they are accompanied by the return authorisation issued by Vitale srl.

The refund, excluding shipping costs (return), will be credited to the same credit and debit card used for the purchase or to the account used for the bank transfer. 

To carry out the return procedure it is necessary to send a RESI e-mail to the e-mail address "[email protected] " indicating the code of the item being returned in order to obtain a Return Merchandise Authorisation (RMA) number.

In order to make the return it is necessary to wait for the authorisation, then the relative return code issued by Vitale srl. 

The e-mail with the return authorisation must be inserted inside the parcel.

Vitale srl will send with the return authorisation a pre-filled sheet with the destination address to be applied to the parcel.

Unauthorised returns are not accepted. Returns are only accepted if the procedure indicated in this paragraph is followed.

Products must be returned in their original packaging to ensure that they are not damaged during shipment.

Product returns are not free of charge if products are returned from a country other than the one originally indicated as the destination address.

For returns, please contact the RETURNS service at '[email protected]'.

Once the return procedure has been completed, you book a pick-up by contacting the courier who made the delivery.

The package must be handed over unopened to the courier.

Vitale srl will send an e-mail confirming receipt of the return and activating the refund procedure. The refund of the price of the returned products is made within 15 days from the date Vitale srl has received the returned product in the indicated conditions.

 

Return Conditions

Products to be returned must not have been worn, used or damaged. They must still have all original tags and security seals intact.

Shoes must be tried on a carpet and returned in the original box, which is an integral part of the product. Shoes returned without a box or in a damaged box may be refused and returned to the customer.

Lingerie and swimwear must be tried on over one's own underwear and without removing the protective sticker.

If the sticker is removed or the garments creased, the return will not be accepted and will be sent back to the Customer. 

Returns that do not meet all the required conditions will not be accepted.

Returns must be addressed to: VITALE SRL via Firenze 68, 88900 Crotone.

To carry out the return, please refer to the "Return Procedure" paragraph.

 

Exchanges

It is only possible to exchange the purchased product with a similar one of a different size or measurement within 10 days from the delivery date and provided that it is available. 

Exchanges requested after the deadline can only be accepted at the discretion of Vitale srl.

To make the exchange you must send an e-mail with the exchange request to the RETURN service "[email protected]".

To make the exchange you must wait for the exchange authorisation issued by Vitale srl. Unauthorised exchanges will not be accepted. Please refer to the procedures indicated in the "Return Procedures" paragraph.

The return of the product does not involve the payment of shipping costs.

Please indicate the new size/measure, respecting the conditions of the return procedure. If you wish to exchange for another item, we recommend that you request a refund and make a new purchase separately. 

The replacement product will be sent to the customer by courier without further shipping costs.

 

Defective merchandise

Products received that are already damaged or show conformity defects are considered defective.

It is possible to request an exchange of the defective product within 10 days from the date of delivery, following the same steps as for Returns/Exchanges.

In such cases, Vitale srl will replace the defective item with an identical one, if available, or repair it if possible.

The replacement product will be sent to the Customer by courier without further shipping costs.

If replacement or repair of the product is not possible Vitale srl will proceed with the refund. The refund, including shipping costs when the product is originally defective, is made to the same credit and debit card used by the Customer for payment.

 

Return of gifts 

In the case of products purchased and sent as gifts, the return can only be exercised by the Customer and in no case by the recipient of the gift, following the same steps as for Returns/Exchanges. 

It is understood that the integrity of the product is an essential condition for exercising the right of withdrawal.

 

Refunds (Reimbursements)

The Customer not satisfied with the product received may exercise the right of return within 10 days from the date of delivery.

Please refer to the same product return procedures expressed in the Returns/Exchanges paragraph.

The refund of the price of returned products shall be made within 35 working days from the date Vitale srl received the returned product in the conditions indicated.

The refund will be made to the same credit and debit card used by the Customer for payment, shipping costs excluded (unless the products are originally defective). 

Customs and sales taxes are not refundable for orders placed outside the EU.

 

LEGAL NOTES AND CONDITIONS OF USE

The site VITALEBOUTIQUE.IT is operated by Vitale srl. 

Access to and use of this site presuppose the reading, knowledge and acceptance of these General Conditions and Privacy Policy ("Privacy Policy") . 

Vitale srl may update the General Conditions of Use and the Privacy Policy at any time. 

By using VITALEBOUTIQUE.IT you accept the Terms of Use and the Privacy Policy as published on the site.

You may consult the current Terms of Use and Privacy Policy at any time by simply clicking on "Terms of Sale" or "Privacy" from the menu at the bottom of the page.

 

Security and Personal Data 

Vitale srl has taken appropriate security measures to protect the personal data and information provided against undue access or use. 

Bank details are neither recorded nor retained on the VITALEBOUTIQUE.IT site, but are stored in a secure database of the bank used by Vitale srl and which appears on the transaction page solely for the purpose of the transaction.

Although Vitale srl has taken all possible precautions to ensure the security of personal data, it must be borne in mind that the transmission of data over the Internet is never completely secure and that any information disseminated online could be collected and used by parties other than those to whom it was addressed. 

The Privacy Policy (see "Privacy") governs the processing of personal data communicated to Vitale srl through the site VITALEBOUTIQUE.IT .

Vitale srl may amend, supplement and / or correct the Privacy Policy at any time; see the current text in the section "Privacy".

 

Intellectual Property

All content of the site VITALEBOUTIQUE.IT (drawings, illustrations, photographs, text, graphics, descriptions, trademarks, images, videos) is the exclusive property of Vitale Srl or licensed to it for use. 

It is prohibited to reproduce, distribute, publish, disseminate, copy, modify or sell by any means, in part or in whole, the content of the site VITALEBOUTIQUE.IT.

It is possible to print material only for personal and non-commercial use.

 

LIMITATION OF LIABILITY - EXCLUSION OF WARRANTY

Limitation of Liability - Disclaimer of Warranty

The VITALEBOUTIQUE.IT site may contain possible imperfections and Vitale srl does not guarantee that they will be corrected.

The VITALEBOUTIQUE.IT site and its content are provided "as is" and "subject to availability".

With the use of the site, the User assumes all risks associated with such use and assumes full responsibility for any loss of use, loss of data and costs due to assistance and repair of hardware and/or software used in connection with the site. Applicable law and jurisdiction

These Conditions are governed by Italian law and are in the Italian language.

The General Terms and Conditions of Sale are governed by Italian law and in particular by Legislative Decree no. 206 of 6 September 2005 on the Consumer Code, with specific reference to the regulations on distance contracts and by Legislative Decree no. 70 of 9 April 2003 on certain aspects of e-commerce

In the event of disputes, the Court of Crotone shall have exclusive jurisdiction.
